These Terms of Service ("Terms") are entered into between AI GO PLAN DO LLC ("aiGoPlanDo," "Company," "we," "us," or "our") and the individual or entity accessing or using the aiGoPlanDo platform and services ("you" or "Customer"). If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and aiGoPlanDo with respect to the Service.
aiGoPlanDo is a cloud-based subscription platform that includes the following services (collectively, the "Service"):
We may add, modify, or discontinue features at any time. We will provide reasonable notice of material changes to existing paid features.
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent that you are at least 18 years old. If you are accessing the Service on behalf of a legal entity, you represent that the entity is validly organized and that you have authority to bind it to these Terms. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
You must create an account to access the Service. When registering, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@aigoplando.com if you suspect unauthorized access to your account.
We reserve the right to refuse registration, terminate accounts, or remove content at our discretion, particularly where there is reason to believe that information provided is inaccurate or that the account has been used in violation of these Terms.
Access to paid features of the Service requires an active subscription. Subscription plans, pricing, and included features are described at aigoplando.com/index.html#pricing and are subject to change as described in Section 5.5.
Payment processing for aiGoPlanDo subscriptions is handled by a third-party payment provider, which is identified to you at checkout before you complete any purchase. Your payment credentials (credit card numbers, bank details) are processed and stored by that provider; aiGoPlanDo does not receive or store your full payment card numbers or bank account details. Where our payment provider acts as Merchant of Record, you are transacting with that provider, and its buyer terms and privacy policy also apply to your purchase; those documents are linked from the checkout page.
On-Site Dispatch Credits are sold as digital products. The purchase is a digital credit transaction completed entirely within the platform; redemption of those credits to schedule a professional on-site service visit is an internal fulfillment matter handled by aiGoPlanDo and does not constitute a separate payment transaction.
Subscriptions are billed on a recurring basis — monthly or annually, as selected at checkout. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize our payment provider (on behalf of aiGoPlanDo) to charge your payment method on file on each renewal date.
The displayed price at checkout will reflect any applicable taxes. Where our payment provider acts as Merchant of Record, that provider is responsible for calculating, collecting, and remitting applicable sales taxes, VAT, GST, and other transactional taxes in jurisdictions where required. Where aiGoPlanDo is itself the merchant of record for a transaction, aiGoPlanDo is responsible for collecting and remitting such taxes in the jurisdictions where it is required to do so.
We reserve the right to change subscription pricing. If we increase the price of your current plan, we will provide you with at least 30 days' advance notice via email or in-app notification prior to the next renewal at the new price. If you do not cancel your subscription before the price change takes effect, your continued use of the Service constitutes your acceptance of the new price.
We may from time to time offer free trials or promotional pricing. Any such offer will be subject to additional terms presented at the time of the offer. We reserve the right to end a free trial or promotional period at any time and to begin charging the applicable subscription fee.
You may cancel your subscription at any time through your account settings or by contacting us at support@aigoplando.com. Cancellation takes effect at the end of your current paid billing period. You will retain access to the Service through the end of that period. For refunds, see our Refund Policy.
Upon cancellation, your account and data will be retained for 30 days in a read-only state so you can export your information. After that period, your data may be deleted in accordance with our data retention practices described in our Privacy Policy.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
We reserve the right to investigate suspected violations of these Terms and to take any appropriate action, including immediately suspending or terminating your account, reporting conduct to law enforcement, or seeking other legal remedies.
You retain full ownership of all content, data, and materials you submit to or create within the Service, including but not limited to appointments, tasks, journal entries, business plans, application specifications, and any other data you upload or generate ("User Content").
By submitting User Content, you grant aiGoPlanDo a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process your User Content solely to the extent necessary to provide and improve the Service to you. This license is limited to operating the Service and does not grant us the right to sell your User Content or use it for advertising or marketing without your separate consent.
You represent and warrant that you have all rights necessary to submit your User Content and that your User Content does not violate the rights of any third party. You are solely responsible for the accuracy, legality, and appropriateness of your User Content.
The Service may generate content through AI models based on your inputs and instructions. Such AI-generated output is provided as a tool to assist you; you are responsible for reviewing, verifying, and taking ownership of any AI-generated content before relying on it for business or legal purposes. aiGoPlanDo does not warrant that AI-generated content is accurate, complete, or fit for any particular purpose.
The Service, including its software, user interface, design, features, trademarks, service marks, logos, and all other content created by aiGoPlanDo (excluding your User Content), is owned by aiGoPlanDo and protected by United States and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
Except as expressly permitted, you may not reproduce, modify, distribute, create derivative works of, publicly display, or otherwise exploit any portion of the Service or its content without our prior written consent.
Feedback. If you provide us with suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a royalty-free, perpetual, irrevocable license to use, modify, and incorporate such Feedback into the Service without any obligation to you.
The Service integrates with third-party services including Google (Calendar, Tasks, Drive) and Microsoft 365 (Outlook Calendar, Tasks, OneDrive) through our PIM Sync feature. Your use of any such third-party service is governed by that provider's terms and privacy policy — not these Terms. We are not responsible for the availability, accuracy, or practices of any third-party service.
By connecting a third-party integration, you authorize aiGoPlanDo to access and synchronize the relevant data from that service on your behalf, as described in our Privacy Policy.
We treat your business data, application specifications, and User Content as confidential information. We will not disclose your confidential information to third parties except as required to operate the Service, as required by law, or with your consent. Our employees and contractors who access your data are bound by confidentiality obligations.
You agree to keep your account credentials confidential and to take reasonable precautions to prevent unauthorized access to your account.
Our Privacy Policy describes how we collect, use, and share information about you when you use the Service. By using the Service, you agree to our collection and use of your information as described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) any errors in the Service will be corrected; (c) the results obtained from using the Service will be accurate or reliable; or (d) AI-generated content or recommendations will be accurate, complete, or suitable for any particular use. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not fully apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIGOPLANDO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability to you for any claims arising under or in connection with these Terms or the Service shall not exceed the greater of: (a) the total fees paid by you to aiGoPlanDo in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the limitation of liability for certain types of damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless aiGoPlanDo and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your breach of these Terms; or (d) your violation of any applicable law or the rights of any third party.
These Terms are effective from the date you first access or use the Service and remain in effect until your subscription is cancelled or otherwise terminated.
You may terminate your account at any time by cancelling your subscription and contacting us. Your cancellation will take effect at the end of your current billing period as described in Section 6.
We may suspend or terminate your access to the Service, with or without notice, if: (a) you breach these Terms; (b) we are required to do so by law; (c) your subscription payment fails and is not corrected within a reasonable period; or (d) we discontinue the Service.
In the event of termination for cause (material breach), we may terminate your account immediately and may not provide a refund for any prepaid subscription fees.
Upon termination, your right to access the Service ceases. Provisions of these Terms that by their nature should survive termination (including Sections 8, 9, 13, 14, 15, 17, and 18) will continue in effect.
These Terms and any dispute arising out of or related to them or the Service shall be governed by the laws of the United States and the State of Indiana, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a formal legal claim, you agree to first contact us at legal@aigoplando.com and make a good-faith effort to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving written notice.
If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may bring individual claims in small claims court. The arbitration shall be conducted in English; the place of arbitration shall be Indiana. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND AIGOPLANDO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a prominent notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.
